Article 1 – Purpose
These General Terms and Conditions of Sale govern the contractual relationship between Autoluxary, a simplified joint-stock company with a capital of €100,000, registered with the Paris Trade and Companies Register under number 123 456 789, whose registered office is located at 15 Avenue des Champs-Élysées, 75008 Paris, France, and any individual or legal entity making a purchase on the website autoluxary.store.
They apply exclusively to the sale of new electric vehicles marketed by Autoluxary. Any order implies full and unconditional acceptance of these General Terms and Conditions of Sale.
Article 2 – Products
The vehicles offered for sale are new electric vehicles, compliant with current European regulations. Each vehicle is accompanied by a detailed technical sheet indicating its essential characteristics: WLTP range, power, battery capacity, charging time, equipment, warranties, and price including VAT.
The photographs and visuals presented on the website are indicative and do not constitute a contractual document. Autoluxary reserves the right to modify the technical characteristics of vehicles without notice, depending on changes made by manufacturers.
Article 3 – Order
The order is validated when the customer completes the online order form, selects their vehicle and options, and proceeds to pay the deposit. A deposit of 10% of the total vehicle price is required to definitively confirm the order.
Upon receipt of the deposit, Autoluxary sends the customer a confirmation email summarizing the order details: model, options, total price, deposit paid, estimated delivery time. This email serves as acknowledgment of receipt and order confirmation.
Autoluxary reserves the right to refuse or cancel any order in the event of suspected fraud, payment default, or supply difficulties with the manufacturer. In this case, the deposit is fully refunded.
Article 4 – Price and Payment
All prices are indicated in euros, including all taxes (TTC), including French VAT at the applicable rate. Registration fees (registration document, ecological penalty if applicable) are not included in the displayed price and remain the responsibility of the customer.
Payment of the balance is made no later than the day of vehicle delivery, by bank transfer or cashier's check. Financing solutions (traditional credit, lease with purchase option) are offered through our approved banking partners, subject to file acceptance.
In the event of late payment, penalties calculated at the legal interest rate increased by 5 points are applicable, in accordance with the French Commercial Code.
Article 5 – Delivery Times
Delivery times are provided as an indication at the time of order. They generally vary between 4 and 16 weeks depending on the model, options chosen, and availability from the manufacturer. Autoluxary undertakes to regularly inform the customer of the progress of their order.
If the indicative deadline is exceeded by more than 30 days, the customer may request cancellation of their order by registered letter with acknowledgment of receipt. All sums paid will be refunded within 14 days.
Delivery delays attributable to force majeure (natural disaster, transport strike, government restrictions, component shortages, etc.) cannot give rise to damages.
Article 6 – Delivery and Acceptance
Delivery of the vehicle takes place at the Autoluxary showroom agreed upon at the time of order. The customer is informed of the delivery date at least 7 days in advance.
Upon acceptance, the customer carries out a detailed inspection of the vehicle in the presence of an Autoluxary advisor: bodywork condition, equipment operation, charge level. A delivery report is signed jointly. Any reservations must be noted on this document.
Home delivery can be arranged upon request, at an additional cost communicated in advance.
Article 7 – Warranties
All new vehicles benefit from the full manufacturer's warranty, for a period of 3 to 5 years depending on the brand (or mileage reached). This warranty covers manufacturing defects and mechanical or electrical failures occurring under normal conditions of use.
The traction battery benefits from a specific warranty for a minimum period of 8 years (or 160,000 km), in accordance with manufacturers' commitments. This warranty covers battery failure and excessive capacity loss.
The detailed conditions of each manufacturer's warranty are available in the warranty booklet provided upon delivery. Wear parts (tires, brakes, wiper blades) are not covered by the manufacturer's warranty.
Article 8 – Right of Withdrawal
In accordance with the applicable consumer protection legislation (EU Directive 2011/83/EU and national transposition measures), the customer has a period of 14 days from the delivery of the vehicle to exercise their right of withdrawal, without having to justify any reason or pay any penalties.
To exercise this right, the customer must notify their decision by registered letter with acknowledgment of receipt or by email to contact@autoluxary.store. The vehicle must be returned in its original condition, with mileage not exceeding 200 km. Return costs are the responsibility of the customer.
Autoluxary undertakes to refund all sums paid, including the deposit, within 14 days from receipt of the vehicle or proof of shipment.
Article 9 – After-Sales Service
Autoluxary ensures the follow-up of all vehicles sold through its dedicated after-sales service. In the event of a breakdown, the customer contacts the after-sales service by email at sav@autoluxary.store or by phone at +33 (0)1 89 23 45 68.
Warranty interventions are carried out within the network of approved repairers partnered with Autoluxary. Appointments are scheduled within 5 working days after the request.
Article 10 – Mediation
In the event of a dispute not resolved amicably, the customer may have free recourse to the competent consumer mediator, whose contact details are provided upon request. In accordance with applicable consumer law, Autoluxary adheres to the consumer mediation scheme.
The customer may also file a complaint via the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/.
Article 11 – Applicable Law
These General Terms and Conditions of Sale are subject to French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Paris, France, notwithstanding plurality of defendants or third-party claims.
If any of the clauses of these General Terms and Conditions of Sale were declared null or unwritten by a court decision, the other clauses would retain their full validity.
